Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Launch Tracker mobile application ("the App", "Service") operated by Epacta Bt. (registered seat: 7634 Pécs, Ércbányász u. 32., Hungary; company registration number: 02 06 074432; tax number: 25465695-1-02; represented by Szilárd Pál) ("we", "us", "our").

1. Description of the Service

Launch Tracker is a mobile application available on iOS and Android that provides information about upcoming rocket launches worldwide. The App offers the following features:

• Real-time countdown timers for upcoming rocket launches
• Detailed launch information including mission details, rocket specifications, and launch pad locations
• Push notifications for launch reminders and schedule changes
• Home screen widgets displaying countdown timers
• Astronaut and crew information for crewed missions

2. Acceptance of Terms

By accessing or using the App, you confirm that:

• You are at least 13 years of age.
• You have read, understood, and agree to be bound by these Terms.
• You have read and agree to our Privacy Policy.

3. Free and PRO Versions

3.1 Free Version

The App is available for free with advertisements. Free users have access to all core features of the App. Advertisements are displayed as banner ads and interstitial ads powered by Google AdMob.

3.2 PRO Subscription

Launch Tracker offers an optional PRO subscription that removes all advertisements. Two subscription plans are available:

3.3 Subscription Terms

• Payment is charged to your Apple App Store or Google Play account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
• You can manage and cancel your subscriptions by going to your account settings on the Apple App Store or Google Play Store after purchase.
• Any unused portion of a free trial period (if offered) will be forfeited when you purchase a subscription.

3.4 Refunds

Refund requests are handled by the respective app store (Apple App Store or Google Play Store) according to their refund policies. We do not process refunds directly.

4. User Conduct

When using Launch Tracker, you agree not to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
• Modify, adapt, translate, or create derivative works based on the App.
• Circumvent, disable, or interfere with security features, advertisement display, or subscription verification mechanisms of the App.
• Use the App for any unlawful purpose or in violation of any applicable laws or regulations.
• Use automated systems, bots, or scripts to access the App or its data.
• Attempt to gain unauthorized access to any portion of the App or its related systems.

5. Launch Data and Content

5.1 Data Source

Launch data displayed in the App is provided by The Space Devs API, a third-party service. We aggregate and display this data for informational purposes.

5.2 Accuracy Disclaimer

You should always verify critical launch information through official sources (e.g., NASA, SpaceX, ESA) before making any plans based on information provided by the App.

5.3 Notifications

Launch notifications and schedule change alerts are provided on a best-effort basis. We do not guarantee the delivery, accuracy, or timeliness of push notifications. Notification delivery depends on your device settings, network connectivity, and operating system behavior.

6. Intellectual Property

6.1 App Ownership

The App, including its design, code, graphics, user interface, and overall structure, is owned by Launch Tracker and is protected by applicable intellectual property laws.

6.2 Third-Party Content

Launch images, agency logos, and other media displayed in the App may be the property of their respective owners (e.g., NASA, ESA, SpaceX, Roscosmos, and other space agencies and launch providers). Such content is displayed for informational purposes under fair use principles. All trademarks, service marks, and logos belong to their respective owners.

6.3 License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

7. Advertisements

The free version of the App displays advertisements provided by Google AdMob. By using the free version, you acknowledge that:

• Advertisements will be displayed as banner ads and interstitial ads during your use of the App.
• Ad content is provided by third-party advertisers and ad networks; we do not control or endorse the content of any advertisements.
• You may be presented with an option to consent to personalized advertisements in compliance with applicable privacy regulations (GDPR, ATT).
• You may remove all advertisements by subscribing to Launch Tracker PRO.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• That the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
• That launch data, schedules, or countdown timers will be accurate or up-to-date.
• That notifications will be delivered on time or at all.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LAUNCH TRACKER, ITS DEVELOPERS, OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or business opportunities.
• Damages resulting from missed launches due to inaccurate data or failed notifications.
• Damages resulting from travel or plans made based on information provided by the App.
• Any damages resulting from your use or inability to use the App.

Our total liability for all claims arising from or relating to the use of the App shall not exceed the amount you paid for the App or subscription in the twelve (12) months preceding the claim.

10. Service Availability

We strive to keep Launch Tracker available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:

• Maintenance and updates.
• Third-party API outages or rate limitations (The Space Devs API).
• Network connectivity issues.
• Force majeure events beyond our control.

We reserve the right to modify, suspend, or discontinue the App or any part of it at any time without prior notice.

11. Termination

You may stop using the App at any time by uninstalling it from your device. We reserve the right to terminate or restrict your access to the App if you violate these Terms.

Upon termination:

• Your license to use the App is immediately revoked.
• Active subscriptions should be cancelled through your app store account to avoid further charges.
• Locally stored data will be deleted when the App is uninstalled.

12. Third-Party Services and Links

The App may contain links to third-party websites, services, or content (e.g., launch webcasts, agency websites). We are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is at your own risk and subject to their respective terms and conditions.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Hungary, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Hungary.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page.
• Make reasonable efforts to notify users of significant changes through the App or this page.

Your continued use of the App after any changes constitutes your acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Launch Tracker regarding the use of the App and supersede all prior agreements and understandings.
